Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of CalendarOnYourWall.com and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.
Accounts and Authentication
Certain features may require authentication via third-party providers (e.g., Google). You agree to provide accurate information and to maintain the security of your account credentials. You are responsible for all activities that occur under your account.
Purchases and Payments
Payments for premium features or digital downloads are processed by Stripe. We do not store card numbers or sensitive payment details. All transactions are subject to Stripe's policies. Prices, features, and offerings may change at any time.
Unless otherwise stated, purchases of digital goods are final and non-refundable, except where required by law. If you experience an issue with a purchase, please contact support.
Your Calendar Data
The Service enables you to create, customize, and optionally sync calendar content. If you choose to store events data with us, we store it securely in our storage. If you choose to store or sync with Google Calendar, your event data is stored in your Google account per Google's terms. We may store limited preferences (e.g., your email and configuration settings) to operate the Service.
User Content and License
You retain ownership of the content you create using the Service. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, display, and process your content solely to provide and improve the Service.
Acceptable Use
- Do not use the Service for unlawful, harmful, or abusive activities.
- Do not attempt to access data or systems without authorization.
- Do not interfere with or disrupt the integrity or performance of the Service.
- Do not misuse third-party integrations or infringe third-party rights.
Intellectual Property
The Service, including software, UI, and content (excluding your content and third-party materials), is owned by us or our licensors and is protected by intellectual property laws. No rights are granted except as expressly set forth in these Terms.
Third-Party Services
The Service may integrate with third-party providers such as Stripe, Cloudflare, and Google. Your use of those services is governed by their terms and policies. We are not responsible for third-party services.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will be preserved without loss.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless CalendarOnYourWall.com and our affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.
Governing Law; Venue
These Terms are governed by the laws of your local jurisdiction unless otherwise required by applicable law. Any disputes will be subject to the exclusive jurisdiction and venue of the courts located in a competent forum where we are primarily established, except where prohibited by law.
